Terms of Service

1. Accounts and Registration

When you create an account with us, you guarantee that you are above the age of 13 and that the information you provide is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for any and all activities or actions that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

2. Payments, Credits, and Refunds

The Service requires you to pay fees. Before you pay any fees, you will have an opportunity to review and accept the fees that you will be charged. All fees are in U.S. Dollars and are non-refundable, except as explicitly stated in our Refund Policy below or as required by law.

• Price: We reserve the right to determine pricing for the Service. We will make reasonable efforts to keep pricing information published on the website up to date. We may change the fees for any feature of the Service, but we will provide you with advance notice of changes before they apply.
• Authorization: You authorize PixReunion and our third-party payment processors to charge all sums for the orders you make to the payment method specified in your account. By submitting your payment information, you grant us the right to provide this information to third parties for purposes of facilitating your purchase.
• Credits: The Service may operate on a credit-based system, where you purchase credits to be used for the generation. Purchased credits are non-refundable and non-transferable. This no-refund policy on credits is strictly enforced.
• Refund Policy: We want you to be satisfied with your purchase. However, due to the automated and resource-intensive nature of our AI service, our refund policy is limited.
  • A full refund, less a 10% processing fee, may be requested within 24 hours of purchase, only if the AI synthesis process for your portrait has not yet been initiated.
  • Once you have submitted your Input Photos and the AI model has begun training or the synthesis process has started, you are no longer eligible for a refund.
  • If you download any version of your Generation, you are not eligible for a refund.
  • To request a refund under these conditions, please contact our support team at support@pixreunion.com.

3. User Content and Generated Portraits

• User Content: Certain features of the Service permit you to upload content, including photographs, images, and other materials ("User Content"). You retain any copyright and other proprietary rights that you may hold in the User Content you upload.
• Limited License Grant to PixReunion: By providing User Content to the Service, you grant PixReunion a worldwide, non-exclusive, royalty-free, fully paid right and license to host, store, transfer, reproduce, and modify (for the purpose of formatting for display and processing) your User Content, solely for the purpose of:
  • (a) Providing and operating the Service and generating your requested Portrait.
  • (b) Complying with applicable law and enforcing our Terms.
• Ownership of Generated Portraits or Videos: You are the owner of your creations. Subject to your compliance with these Terms, PixReunion hereby assigns to you all of its right, title, and interest (if any) in and to the specific Generated Portraits you create and purchase through the Service. You are free to use your Generated Portraits for any personal or commercial purpose.
• User Content Representations and Warranties: You are solely responsible for your User Content and the consequences of providing it. By providing User Content, you affirm, represent, and warrant that:
  • (a) You are the creator and owner of the User Content, or have the necessary licenses, rights, consents, and permissions to authorize PixReunion to use your User Content as described in these Terms.
  • (b) Crucially, you have obtained all necessary consents, permissions, and releases from every identifiable individual depicted in your User Content, including from the parents or legal guardians of any minors, to submit their likeness and for it to be used to create a new, synthesized image.
  • (c) Your User Content does not and will not infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, or right of publicity.
• User Content Disclaimer: We are under no obligation to edit or control User Content that you or other users post and will not be in any way responsible or liable for User Content. We may, however, at any time and without prior notice, screen, remove, edit, or block any User Content that in our sole judgment violates these Terms or is otherwise objectionable.

4. Data Retention and Deletion

We take your privacy and data seriously.

• Input Photos: Your uploaded Input Photos are stored securely and are automatically deleted from our active servers within 30 days after your Generated Portrait is delivered.
• Generated Portraits or Videos: Your final Generated Portraits are stored in your account for you to access and download. You may delete them from your account at any time.
• Account Data: Your account information (email, name, etc.) is stored as long as your account is active. Upon a full account deletion request, this data will be deleted within 90 days in accordance with applicable laws.

5. Prohibited Conduct

By using the Service, you agree not to:

• (a) Use the Service for any illegal purpose or in violation of any law or regulation.
• (b) Upload any content that is unlawful, defamatory, libelous, pornographic, harassing, hateful, or otherwise objectionable.
• (c) Violate or encourage others to violate any right of a third party, including by infringing any intellectual property or privacy right.
• (d) Interfere with security-related features of the Service, including by reverse-engineering or attempting to discover the source code of any portion of the Service.
• (e) Interfere with the operation of the Service, including by uploading viruses or malicious code.
• (f) Perform any fraudulent activity, including impersonating any person or entity.
• (g) Sell or otherwise transfer the access granted under these Terms.

6. Intellectual Property and Copyright Policy

• PixReunion's Intellectual Property: The Service and its original content (excluding User Content and your final Generated Portraits), features, and functionality are and will remain the exclusive property of PixReunion. and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.
• Copyright Policy (DMCA): We respect the intellectual property rights of others. It is our policy to respond to any claim that content posted on the Service infringes on a copyright. If you are a copyright owner and believe that your work has been infringed upon, please submit a claim via email to support@pixreunion.com with the subject line: "Copyright Infringement".

7. Feedback

If you provide us with information and feedback concerning errors, suggestions for improvements, ideas, or other matters related to our Service ("Feedback"), you assign all rights in that Feedback to us. You agree that we can use it without any restriction or compensation to you.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason, including but not limited to a breach of Terms. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

9. Disclaimer of Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PIXREUNION DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS. YOU ACKNOWLEDGE THAT THE AI TECHNOLOGY IS EXPERIMENTAL AND MAY PRODUCE UNEXPECTED OR INACCURATE RESULTS. YOU RELY ON ANY OUTPUT FROM THE SERVICE AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PIXREUNION BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS OR GOODWILL) ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

11. Indemnity

You agree to defend, indemnify, and hold harmless PixReunion Inc. and its officers, directors, employees, and agents from and against every claim, liability, damage, loss, and expense, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to, use of, or misuse of the Service; (b) your violation of any portion of these Terms; or (c) your violation of any third-party right, including any intellectual property or privacy right.

12. Dispute Resolution and Arbitration

• Generally: You and PixReunion agree that every dispute arising in connection with these Terms will be resolved by binding, individual arbitration. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND PIXREUNION ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
• Exceptions: This agreement to arbitrate does not apply to: (a) individual actions in small claims court; (b) enforcement actions through applicable government agencies; or (c) suits in a court of law to address an intellectual property infringement claim.
• Arbitrator and Rules: The arbitration will be administered by JAMS under its Consumer Arbitration Rules.
• No Class Actions: YOU AND PIXREUNION AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
